Terms & Conditions and Privacy Policy – Sakba (sakba.ae)

Please read this document carefully before using the Sakba website (sakba.ae).
By continuing to use the Website or completing any purchase, you acknowledge and agree to these Terms & Conditions, the Privacy Policy, the Refund & Exchange Policy, and the Cookies Policy.

1. Definitions


• "Website" or "sakba.ae": The official website operated by Sakba.
• "Sakba" or "the Company": The commercial entity operating the sakba.ae platform.
• "User" or "Customer": Any person who accesses, uses, or makes a purchase through the Website.
• "Products": All products offered for sale on the Website, including tea, blends, accessories, majlis products, games, and any future items.
The sakba.ae platform is operated by Sakba for Tea L.L.C – S.P.C, a company duly licensed and registered in the Emirate of Abu Dhabi, United Arab Emirates. This entity is the legal party responsible for operating the Website and entering into sale contracts through it.

2. Acceptance of Terms

By using the Website, creating an account, or placing an order, you agree to be bound by this document. If you do not agree, you must discontinue use of the Website immediately.

3. Legal Age


By using the Website, you confirm that you are at least 18 years old or using the Website under the supervision of a legal guardian.

4. Scope of Services

The Website provides an online platform for offering and selling a variety of products, including, but not limited to, Sakba-branded products, tea products from other brands, as well as tea accessories, majlis products, gift packages, and related items, whether branded under Sakba or other trademarks.

Third-Party Brands Notice:
The Website may offer products bearing third-party trademarks. All trademarks and brand names are the property of their respective owners. Such products are offered strictly for retail sale purposes, without any agency, partnership, or commercial representation relationship.


5. Account & Information Responsibility

Customers are responsible for ensuring that all information provided during account registration or checkout is accurate and complete, including name, phone number, and shipping address.
Sakba shall not be liable for any delay, loss, or delivery failure resulting from incorrect or incomplete information.

 6. Contact & Notices

For any inquiries, complaints, or official communications relating to orders or policies, you may contact us through the official channels listed on the "Contact Us" page on the Website. The email address provided by the customer shall be used as an official method for order-related notices (including confirmations, updates, or refunds).

Invoices/receipts are issued electronically to the registered email address and constitute valid proof of purchase.

7. Website Misuse

The Website may not be used for any unlawful or unauthorized purpose, including but not limited to attempting to hack, disrupt, manipulate pricing, place fraudulent orders, misuse payment methods, or publish misleading or harmful content.

Sakba reserves the right to suspend or terminate any account or order involved in misuse without prior notice and to take legal action where necessary.

8. Pricing & Payments

All prices are displayed in UAE Dirhams (AED).

Prices may be adjusted in case of tax or regulatory changes imposed by competent authorities.

Prices may include VAT or display it separately, as indicated.

Sakba reserves the right to modify prices or promotions at any time.

Payments are processed through secure and approved payment gateways.


Pricing & Description Errors

Sakba makes every reasonable effort to ensure that all product descriptions, images, and pricing information are accurate. However, errors may occur. In such cases, Sakba reserves the right to correct any error, update information, or cancel orders prior to shipment, even after an order confirmation has been issued. Any payments made will be fully refunded.

Product Images Notice: Minor differences in color or packaging may occur due to lighting, screen settings, or supplier packaging updates. Images are for illustration purposes, and the product description on the product page shall prevail.

Displaying products on the Website does not constitute a binding offer to sell in case of clear system or pricing errors.

Placing an order on the Website does not constitute final acceptance. A binding sale contract is formed only upon dispatch confirmation by Sakba.

9. Right to Refuse or Cancel Orders

Sakba reserves the right to refuse or cancel any order at any time for legitimate reasons, including but not limited to:

  • Product unavailability

  • Errors in pricing or description

  • Suspected fraudulent activity

  • Incorrect or incomplete customer information

If an order is cancelled after payment has been processed, the refund will be issued via the original payment method within 3–7 business days.

10. Order Cancellation Policy

Orders may be cancelled only before shipment.
Once the order has been handed over to the shipping provider or preparation of customized products has started, cancellation will not be accepted.

Sakba reserves the right to reject cancellation requests if order processing, preparation, or customization has already begun.

If cancellation is approved before shipment, refunds will be processed within 3–7 business days via the original payment method.

11. Shipping & Delivery

Orders are confirmed through official communication channels.

Shipping fees and delivery times vary by location and product type and are disclosed at checkout or communicated prior to dispatch.

Sakba is not responsible for delays caused by third-party carriers or circumstances beyond its control.

 

The risk of loss or damage transfers to the customer upon actual delivery to the customer, except where damage is attributable to the shipping carrier after dispatch or circumstances beyond Sakba's control.

If delivery fails due to an incorrect or incomplete address, or due to the customer's failure to respond to the shipping provider within the required timeframe, the shipment may be returned to Sakba. In such case, the customer shall be responsible for any return or re-delivery fees.

12. Refund & Exchange Policy

All refunds and exchanges are governed by Sakba's official Refund & Exchange Policy, which forms an integral part of this document.

13. Privacy Policy

Sakba is committed to protecting user data in accordance with its Privacy Policy and applicable laws. Personal data is processed in accordance with the applicable laws and regulations of the United Arab Emirates, including relevant data protection legislation.

14. Cookies

The Website uses cookies to enhance user experience and analyze usage. Disabling cookies may affect certain Website functionalities.

15. Data Security

Appropriate technical and organizational measures are implemented to protect personal data. However, no method of transmission over the internet can be guaranteed to be fully secure, and use of the Website constitutes acceptance of this risk.

All content displayed on the Website, including but not limited to designs, texts, logos, images, videos, product descriptions, blends, marketing concepts, visual identity, and any other digital or visual materials, is protected under the intellectual property laws of the United Arab Emirates.

All rights are reserved by Sakba. No part of the Website content may be copied, reproduced, distributed, modified, or exploited in any form without prior written consent from Sakba.

This includes, without limitation, Sakba blends, product names, logos, marketing content, and the overall website layout and design. Any unauthorized use may result in civil or criminal liability under applicable laws.

Resale for commercial purposes, redistribution, or using the Products/content for marketing under another name is prohibited without Sakba's prior written consent, without prejudice to the customer's statutory rights.

17. External Links

The website may contain links to third-party websites or platforms that are not controlled by Sakba, including social media platforms, payment gateways, or shipping providers.
Sakba shall not be responsible for the content, policies, or practices of such external websites. Use of such links is at your own risk.

18. Limitation of Liability

To the maximum extent permitted by law, Sakba, its management, employees, or suppliers shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Website or its products. In all cases, Sakba's liability, if any, shall be limited to the total amount paid by the customer for the relevant order.

Sakba shall not be liable for any delay or failure resulting from circumstances beyond its reasonable control, including force majeure events.

Sakba shall not be liable for any loss of profits, business losses, or indirect damages of any kind.

Force Majeure: Sakba shall not be liable for delays or failure caused by events beyond its reasonable control, including disasters, public outages, government actions, or carrier/payment disruptions. This limitation shall not affect any mandatory statutory rights granted to consumers under applicable law.

19. Product Usage & Liability Disclaimer

All products sold on the Sakba website must be used in accordance with their intended purpose and any provided instructions.

Sakba shall not be held liable for any damage, injury, loss, or misuse resulting from improper handling, incorrect use, negligence, or failure to follow usage guidelines.

The customer assumes full responsibility for the safe and appropriate use of all purchased products after delivery.

Certain products may require supervision, proper handling, or specific environmental conditions. It is the customer's responsibility to ensure suitability and safe use.


 20. Food & Consumption Disclaimer

All food products sold on the Sakba website are intended for general consumption purposes only and are not medical or therapeutic products.
Sakba shall not be liable for any allergic reactions, sensitivities, or health issues arising from product consumption, except where required by applicable law.
Customers are responsible for ensuring that the products are suitable for their individual health conditions prior to use.

21. Amendments

Sakba reserves the right to amend this document at any time. Continued use of the Website constitutes acceptance of the updates.

22. No Waiver

Failure by Sakba to enforce any right under these Terms shall not constitute a waiver of such right.

23. Assignment

Sakba may assign or transfer its rights and obligations under these Terms to a third party where necessary, without affecting the customer's statutory rights.

24. Entire Agreement

These Terms, together with the referenced policies (Privacy Policy, Refund & Exchange Policy, Shipping Policy, and Cookies Policy), constitute the entire agreement between Sakba and the customer regarding the use of the Website and purchases made through it, and supersede any prior communications or understandings relating to the same subject.

25. Governing Law, Jurisdiction, and Language

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, with exclusive jurisdiction vested in the courts of the Emirate of Abu Dhabi.

In the event of any conflict between the Arabic version and any translated version, the Arabic version shall prevail and be legally binding.

26. Official Language of Communication

The Website operates in both Arabic and English. Official communications may be issued in either language. In case of any discrepancy, the Arabic language version shall prevail for legal and interpretative purposes.


27. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
